GuardianAI Terms of Service

Summary: GuardianAI is a parental safety monitoring service. By using it, you agree to use it responsibly and lawfully to protect your children. You must have legal parental or guardian authority over any child whose device you monitor.
1. Acceptance of Terms
By creating an account or using GuardianAI ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
We may update these Terms from time to time. Continued use after changes constitutes acceptance. We will notify you of material changes via email or in-app notification.
2. Service Description
GuardianAI provides parental safety monitoring tools including:
- Screen time monitoring and management
- Web content filtering via DNS-level VPN
- On-device AI threat detection (grooming, cyberbullying, self-harm indicators)
- Location tracking and geofence alerts
- App usage tracking and reporting
- Weekly safety digest reports
- Emergency SOS and distress signal features
- One-way audio monitoring (parent-initiated)
- Battery protect mode (restricts device when battery is low)
- Ride-share safety monitoring (auto-detects trips and shares details with parent)
GuardianAI is a parental monitoring tool, not a surveillance product. It is designed to help parents protect children from online dangers while respecting family privacy through end-to-end encryption.
3. Eligibility and Parental Authority
You must be at least 18 years old and have legal parental or guardian authority over any child whose device you monitor using GuardianAI.
You represent and warrant that:
- You are the legal parent or guardian of the child
- You have the legal right to monitor the child's device and digital activity
- You will comply with all applicable laws regarding parental monitoring in your jurisdiction
- You will not use the Service to monitor any person over whom you do not have legal authority
- You consent to all monitoring capabilities of the Service including audio monitoring, location tracking, screen monitoring, and app usage tracking on the child's device
- You understand that as the device owner, you are granting consent for all monitoring features on behalf of your minor child
4. Audio Monitoring and Recording
GuardianAI includes audio monitoring capabilities that allow the parent or guardian to:
- Eavesdrop mode: Initiate one-way audio listening from the child's device microphone at any time. Audio may be recorded and stored (encrypted) for later review.
- Distress signal: When triggered by the child (or automatically by the system), audio recording begins and is streamed to the parent along with real-time location data.
- Call monitoring: On supported devices, the Service may analyze phone call audio for safety threats using on-device AI. Raw call audio is never transmitted to GuardianAI servers.
By installing GuardianAI on a device, the device owner (parent/guardian) consents to all audio monitoring capabilities. The parent is the owner of the device and is granting this consent on behalf of their minor child as their legal guardian.
Audio monitoring features may be subject to applicable wiretapping and recording consent laws in your jurisdiction. GuardianAI is designed for use by parents monitoring their own minor children's devices and should not be used to monitor any person without legal authority to do so.
5. Family Account Definition and Sharing Policy
A GuardianAI "family" account is defined as one household unit — parents or legal guardians and their minor children who reside at the same primary address. This includes:
- Biological children, adopted children, stepchildren, and foster children residing in your household
- Children who split time between two households (shared custody) — both households may use the same family account
- Co-guardians (e.g., both parents, grandparents with legal guardianship) sharing monitoring responsibilities
Account sharing is strictly prohibited. You may NOT:
- Share your account credentials with another family or household
- Add children who are not your legal dependents
- Use one subscription to cover children from multiple unrelated families
- Resell, redistribute, or sublicense access to the Service
Monitoring and enforcement: We monitor device network patterns to ensure account usage is consistent with a single household. If we detect patterns indicating cross-household sharing (such as devices that never connect from a common network), we may:
- Contact you to verify your account usage
- Require additional verification of your family composition
- Suspend monitoring features until verification is completed
- Charge a penalty fee of up to 3 months of your subscription rate
- Terminate your account for repeated violations
If you have a unique family situation (military deployment, boarding school, etc.) that may trigger our sharing detection, please contact us at support@guardianaiapp.com to whitelist your account.
5. COPPA Compliance and Parental Consent
GuardianAI complies with the Children's Online Privacy Protection Act (COPPA). Before any data is collected from a child under 13, we require verifiable parental consent through one of the following methods:
- Credit card micro-charge verification (charge is refunded after verification)
- Email-plus verification (for limited data collection)
You may revoke consent and request deletion of your child's data at any time through the app or by contacting us.
6. Account Security
You are responsible for maintaining the security of your account credentials. You agree to:
- Use a strong, unique password
- Enable two-factor authentication when available
- Not share your account credentials with unauthorized persons
- Notify us immediately if you suspect unauthorized access
7. Acceptable Use
You agree NOT to use GuardianAI to:
- Monitor any person without legal authority to do so
- Stalk, harass, or engage in domestic surveillance of adults
- Violate any applicable law or regulation
- Attempt to circumvent, disable, or interfere with security features
- Reverse engineer, decompile, or disassemble the Service
- Use the Service for any commercial purpose other than family safety
- Transmit malware, viruses, or harmful code through the Service
8. End-to-End Encryption
GuardianAI uses end-to-end encryption (E2EE) to protect your family's data. This means:
- Safety alert data is encrypted on the child's device before transmission
- Only you (the parent) can decrypt and view your child's activity data
- GuardianAI servers store encrypted data they cannot read
- You are responsible for safeguarding your encryption recovery key
If you lose your encryption key and recovery phrase, your encrypted data cannot be recovered. GuardianAI cannot assist with decryption.
9. Subscriptions and Payment
GuardianAI offers paid subscription plans. By subscribing, you agree to:
- Pay the applicable subscription fees
- Automatic renewal at the end of each billing period unless cancelled
- Pricing changes with 30 days advance notice
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
10. Data Handling
Your use of GuardianAI is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
Key points:
- On-device AI processes content locally on the child's device
- Only encrypted safety alerts and metadata are transmitted to servers
- We never sell, share, or monetize your family's data
- You can request data export or deletion at any time
11. Limitation of Liability
GuardianAI is a safety tool that assists parents but does not guarantee complete protection. To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We do not guarantee that all threats will be detected or prevented
- We are not liable for any harm resulting from threats that the Service fails to detect
- Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
GuardianAI is not a substitute for active parental supervision, open communication with your children, or contacting law enforcement when appropriate.
12. Indemnification
You agree to indemnify and hold harmless GuardianAI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Unauthorized monitoring of persons over whom you lack legal authority
13. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the app settings.
Upon termination:
- Your subscription will be cancelled
- Your encrypted data will be retained for 30 days, then permanently deleted
- Consent records are retained for 7 years per legal requirements
14. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.
